Fixed penalty notices

Officers investigating incidents of anti-social behaviour or environmental crime may issue a fixed penalty notice (FPN) for the following offences:

• Littering
• Dog fouling
• Fly-tipping including duty of care
• Nuisance parking
• Abandoning a vehicle
• Unauthorised distribution of literature on designated land
• Graffiti and fly-posting
• Failure to produce authority (Waste Carriers Licence)
• Failure to furnish waste documentation
• Waste receptacle and putting out waste offences
• Breach of Public Spaces Protection Order (PSPO)
• Breach of Community Protection Notice (CPN)

Fixed penalty notice amounts

The amount of a fixed penalty notice is set using guidelines for penalty notice levels.

Failure to pay a fixed penalty notice within 14 calendar days from the notice being issued may result in legal proceedings being brought against you for the offence.

Appealing a fixed penalty notice

There are no formal grounds of appeal against an FPN. It is an invitation for you to discharge your liability to prosecution. In essence, this means that whilst this is not an admission of your guilt and by paying the sum of money specified, no further action will be taken by, or on behalf of the Council.

Failing to pay a fixed penalty notice

If you do not pay the FPN within 14 days from the date of issue, we will send you a Final Warning Letter to remind you that the payment is overdue. The Final Warning Letter gives you a further 7 days to pay the FPN. If you still do not pay within 7 days after the date of the Final Warning Letter, the case will be referred to The Council’s legal team for prosecution.
