Owner of run down Hucknall business prosecuted

Trent Properties Limited of Castlegate, Lincolnshire, owners of the property adjacent to Albert Street Hucknall, were issued the Enforcement Notice under Section 215 of the Town and Country Planning Act 1990. The Council’s Planning Enforcement Team issued the Notice due to the condition of the premises. The order required the removal of overgrown vegetation, excess waste and graffiti, as well as repairs to the guttering and to secure the building to prevent further damage.

The order required the remedial work to be completed by 10th January 2021, however Trent Properties Limited chose not to appeal the Notice and the improvement work was not carried out.  Therefore, the Council’s Planning Team took prompt action to prosecute Trent Properties.

Trent Properties Limited were convicted at a hearing at Nottingham Magistrates Court on the 20th of April. They received a fine of £660.00 and they are also required to pay an additional £1,862.25 towards costs, including those incurred by the Council totalling £2522.25.

Cllr Helen-Ann Smith, Cabinet Member for Community Safety and Crime Reduction, said “We support and encourage all business ventures in the District. However, we expect all businesses to maintain safe and secure buildings that meet the standards expected by the Council.

 

“If action was taken over the original Enforcement Notice the fine could have been avoided. This should act as a warning to other business that don’t maintain their premises; we won’t hesitate to pursue enforcement measures.  We are committed to making Ashfield a pleasant place to live, work and visit.”
