Empty properties – Class C Discount

Generally, dwellings left unfurnished after vacation get a free period of up to one month. A 75% charge then applies for a further five months. After this period a 100% charge will apply.

Properties empty after two years will be charged an additional 50% premium. From 1st April 2019 the premium will increase to 100%.

If the dwelling is furnished but unoccupied, no discount will apply.

Empty properties requiring major repair works (Class D Discount)

Generally, uninhabitable dwellings or dwellings requiring major repair works and left unfurnished after vacation get a free period of up to one month. A 75% charge then applies for a further five months. After this period a 100% charge will apply.

Properties empty after two years will be charged an additional 50% premium. From 1st April 2019 the premium will increase to 100%.

If the dwelling is furnished but unoccupied, no discount will apply.

The discount applies from the date the property became unoccupied and unfurnished and not the date the property required the work or changed owner.

Changes to the long term empty property charge

Rating (Property in Common Occupation) and Council Tax (Empty Dwellings) Act 2018

On 1st November 2018 Section 11B of the Local Government Finance Act 1992 (higher amount for long-term empty dwellings: England) was amended to allow Councils to increase the Council Tax empty property premium from 50% to 100% for dwellings that have been unoccupied and unfurnished over 2 years but less than 5 years.  The new legislation also allows councils to triple council tax on dwellings that have been continuously unoccupied between 5 and 10 years, and quadruple it on properties that have been continuously unoccupied for more than 10 years.

Ashfield District Council has decided to implement all of the new empty property premiums.  These premiums will apply from 1st April 2019.   The new 100% premium will be included in the 2019-20 Council Tax annual bills for all empty properties that have been unoccupied for over 2 years.

For the financial year beginning on 1 April 2020 a 200% premium will be included on council tax bills for all dwellings that have been continuously unoccupied and unfurnished between 5 and 10 years.

For the financial year beginning on 1 April 2021 a 300% premium will be included on council tax bills for all dwellings that have been continuously unoccupied and unfurnished for a period exceeding 10 years.
